Abstract:The data rights system is the foundation for the effective operation of data circulation rules,yet its construction remains in the exploratory stage,especially in terms of rights ownership,which is controversial.Data products are the most mature type of data in terms of form,and can be included in the category of property rights objects first.However,the existing institutional interpretations is difficult to provide sufficient basis for determining the ownership of data product property rights.How to effectively connect traditional property rights theory with the new object of data products has become a key issue that the legal system must respond to.The processing system in traditional property rights theory has similarities in the logic of property rights confirmation with the generation of data products,that is,the combination of raw materials and labor generates new entities,leading to changes in the ownership of raw materials.This analogy provides theoretical support for the ownership determination of data products.Leveraging the processing system can clearly demonstrate the contribution measurement and scope of rights enjoyed by each participant in the data product generation process.The labor contribution of data processors in the process of generating data products is significantly higher than that of data sources provider.Therefore,the property rights of data products should belong to the data processors.At the same time,the principle of balancing interests in the processing system can be used to provide corresponding compensation to data sources provider.

Abstract:In the context of the deep integration between intangible cultural heritage protection and digital cultural industry,the lion dance,as an important symbol of Lingnan culture,has become an important path to creatively transform intangible cultural heritage through IP based practices.Taking the animated film series"I Am What I Am"as the core case,this paper analyzes the process of transforming lion dance from traditional folk practice to cultural IP,and explores the transformation of lion dance culture in terms of identity subjects,identity objects,and identity methods.The study finds that the IP transformation of lion dance has achieved widespread dissemination across regions and generations through the translation of spiritual cores and the reconstruction of cultural symbols,effectively activating the interest of young people in lion dance culture.However,it has also triggered a triple contradiction:the weakening of the sacredness of traditional rituals,the generalization of regional cultural symbols,and the lack of discourse power of the inheritors.

Abstract:Against the backdrop of increasing global emphasis on sustainable development and corporate social responsibility,ESG concepts have become an important criterion for comprehensive evaluation of corporate value.There is a close correlation between the performance of ESG environment dimension(E)and the performance of cross-border mergers and acquisitions by enterprises.An empirical study was conducted using cross-border M&A data from Chinese A-share listed companies from 2011 to 2022 as a sample to analyze the impact and mechanism of corporate ESG environmental performance on cross-border M&A performance.The research finds that there is a significant positive correlation between corporate ESG environmental performance and cross-border M&A performance,with financing constraints playing a partial mediating role.Further research shows that the promoting effect of the ESG environmental dimension performance on the performance of cross-border mergers and acquisitions is more significant in non-state-owned and non-high-tech enterprises.Based on the above conclusions,the following implications are proposed:at the enterprise level,environmental responsibility should be integrated into the entire process of cross-border mergers and acquisitions,and financing channels should be expanded with good environmental performance.At the policy level,it is necessary to strengthen the disclosure and supervision of corporate environmental information to regulate corporate behavior,and implement differentiated incentive policies to effectively stimulate the enthusiasm of enterprises to fulfill their environmental responsibilities.

Abstract:The systemic financial risks that may be associated with the financialization of superplatforms have attracted extensive attention from the international community.China's existing regulatory measures focus more on the prevention of possible financial risks from the perspective of ex post fintech governance of superplatforms across financial industries,and to a certain extent neglect the construction of ex ante anti-monopoly regulatory system.Based on the requirements of the quasi-public space attribute of super-platforms,the encouragement of innovation and the need to prevent and resolve systemic financial risks,it is necessary to carry out anti-monopoly regulation on the transformation of super-platforms'financialization.However,the effective implementation of anti-monopoly regulation still needs to realize the value balance between platform autonomy and external regulation,effectively respond to the impact of market order under the possibilities of winner-take-all and big-but-not-fail,and effectively configure the supervisory powers of different authorities in financial supervision and competition enforcement.Based on the improvement of market competition order in the financialization of super-platforms,the effective implementation of antitrust regulation should focus on the construction of a regularized antitrust regulation mechanism,the promotion of internal compliance construction of platform enterprises,and the promotion of the modernization such as digitalization and intelligence to better realize the antitrust regulation of the financialization of superplatforms.

Abstract:The development of digital technology has brought new tools,platforms,and ideas to creative writing,but it also caused the dilemmas of subjectivity alienation among teachers and students in digital creative writing.It was found that students experience a decline in creativity due to overreliance on digital writing tools,while teachers face homogenization in instructional design as a result of the instrumentalization of technology.The research further reveals that the habitus of exam-oriented education and the urban-rural digital divide jointly exacerbate this alienation.This paper integrates Marxist alienation theory and digital humanism and proposes five reconstruction strategies:digital and intelligent empowerment,interdisciplinary integration practices,redefinition of teachers'roles,process-oriented intelligent evaluation,and equitable resource allocation.The study provides a practical approach integrating Marxism and digital humanism to address technological alienation,promoting a return to education's essence of"holistic human development."
