Legal analysis and instructional construction of the agreed delivery address service before litigation

Abstract:Delivery service is an important civil action,which runs through the whole process of civil litigation,and is an effective guarantee for the smooth progress of the litigation procedure.The agreed delivery address system,while ensuring the legitimacy of the procedure,improves delivery efficiency and saves judicial costs through its convenience,which helps to solve the problem of"difficult service".This system has the effect of presumed delivery and is an important innovation in the reform of the delivery system.However,although the agreed delivery address system has been applied in practice,there are still many controversies regarding its application due to the lack of clear legal basis and unified operational norms.From a legal perspective,the delivery address agreed before litigation belongs to an independent dispute resolution agreement and is essentially a litigation contract.Therefore,it is necessary to establish a sound system of agreed delivery addresses and clarify the specific case type,specific content of the agreement,effectiveness,accountability and remedial measures,so as to form a unified and operable application standard.
