Lucke's State and Its Variant from the Perspective of the Structure of Property-rights

Abstract:Whether in Lucke's state of nature or in his political society, private property-rights both are absolutely superior to pubic property-rights and have relative precedence over self-ownership.The severely unbalanced structure of property-rights is made institutionalization and legal by Lucke's dual social contract, which constitutes the economic foundation of the Luck's state and its variant.The Luck's negative state results from the captive state, with night-watchman state served as its appearance and exploitative state actualized as its nature.The severely unbalanced structure of property-rights contributes a lot to the overriding of state power by social power, the suppression of captive power on labor sovereignty, the dearth of the state autonomy, the limitation of the state function, the weakening of the state capacity, the laissez-faire, the deficiency of fairness and justice, and finally the state failure.
