Legal Risks and Avoidance Strategies of Chinese Medicine Clinical Pathway
Abstract：By analyzing the legal nature and risks of Chinese medicine Clinical Pathway,the paper reaches the conclusion that Chinese medicine Clinical Pathway is a group of technical guidance documents.Although it is issued by the State Administration of Traditional Chinese Medicine of People's Republic of China,its legal status is inferior to department regulations,as technical guidance instead of technical criterion.In practice,Chinese medicine Clinical Pathway runs some potential risks:deviating from the target of promoting health,misleading the mediation and the court decision,affecting medical treatment without offering legal protection etc.In order to avoid the legal risks in Chinese medicine Clinical Pathway,the paper will discuss the avoidance strategies from the perspect ves of "defending" "attacking"and"harmony".
