Discussion on Personal Information Consent Rules for Artificial Intelligence Application in Medical Field

Abstract：Artificial intelligence(AI)is more and more widely used in the medical field,but the data processed by it often involves sensitive personal information,so the rules for personal information processing should be strictly observed to fully protect the rights and interests of personal information.Informed consent rules are the core of personal information processing rules,so AI applications in the medical field should comply with informed consent rules.If AI processing personal information can comply with China's personal information processing informed consent rules,this naturally belongs to the ideal state.However,AI has the characteristics of moral choice and independent development,which leads to the uncertain state of personal information processing purpose,method,scope and corresponding risks,resulting in the application of AI in the medical field and the specific consent system of China's current personal information processing rules not be fully adapted,making regulation disorder,rights and interests damage,innovation obstruction and so on,which are quite common.It is reasonable to expand the interpretation of the purpose limitation principle and promote the broad consent legislation to apply AI.
