Practical research on early resolution mechanism for drug patent disputes

Abstract：The drug patent link system has been implemented in our country in 2021,and currently is still in the early stage of operation.The implementation methodology still needs to be refined and there are also some confusions in the operational practices of pharmaceutical companies.This paper studies and analyzes the current status of the early resolution mechanism for drug patent disputes,and integrates the litigation cases to analyze what is"drug-related patent information",the applicable types of pharmaceutical patents,the understanding of the four types of declarations,and how to define the success of the first challenge to the patent,with a view to providing a reference for the practice of the relevant pharmaceutical enterprises,and providing comments and suggestions for the further optimization of the institutional system.
