Abstract：This article summarized the judicial precedent of traditional Chinese medicine (TCM) patentrelated creative law in our country and analyzed the overall regularity of litigation conclusion.The results showed that the conclusion of lawsuit correlated with the type of TCM innovation.The development of TCM industry in China should conform to the national situation and the development trend of industry.
