Mediation and Arbitration of Rural Land Disputes from the Perspective of"Fengqiao Experience"in the New Era

Abstract:Rural land disputes are characterized by their mass,social,local,and administrative nature.The concept of source governance and diversified dispute resolution advocated by the"Fengqiao Experience"in the new era provides valuable guidance for improving the coordination mechanism between mediation,arbitration,and litigation for rural land disputes.This article reviews the practical evolution and legislative development of rural land dispute resolution models in China.It identifies several issues within the current coordination mechanism,including a fragmented legal framework,a lack of cross-departmental collaboration,and insufficient authority of arbitration institutions.Consequently,construction pathways for this mechanism are proposed from the perspective of the"Fengqiao Experience".These include:establishing a tripartite procedural coordination system integrating mediation,arbitration,and litigation,with a focus on enhancing pre-litigation coordination;building a collaborative governance network between grassroots organizations and the judicial system to standardize dispute resolution standards;and promoting the systematic training of arbitrators to strengthen the credibility of rural land dispute mediation and arbitration institutions.
