The Bargain and Coexistence of the Dualistic Law System in Rural Society --A Case on the Married Women’s Villager Right

Abstract:In recent years, married women’ villager qualification has caused many conflicts and some of them have appealed to the law. In the conflicts, the married women have tried to protect their rights according to the formal system, and other villagers, whose representation is the committee of villagers’ representation, have denied these married women’ villager right according to patrilineal law of Chinese traditional society. The former is from the modern industry culture, and the latter is from the agriculture culture of traditional China. Their coexistence has shaped the Chinese society, especially the basic characteristics of the rural social order.
