Preserving tradition and innovating progress:the normative evolution and prospects of the Mineral Resources Law

Abstract:The latest revision of the Mineral Resources Law in 2024 upholds the principles of resource security,ecological civilization,and sustainable development while achieving an organic integration of"preserving tradition"and"innovating progress".In terms of continuity,the new law maintains the state ownership system of mineral resources,retains the existing land use management model for mining activities,and continues the resource taxation and fee system to rationally regulate mineral revenue distribution.In terms of innovation,the law systematically improves the market-based allocation mechanism for mining rights by introducing a competitive bidding system to enhance fairness and transparency in resource allocation.Additionally,it strengthens ecological restoration responsibilities by establishing mandatory mine closure and rehabilitation requirements and institutionalizing public participation procedures to enhance the democratic legitimacy and transparency of resource governance.Despite these advancements,challenges remain in legal enforcement,tax regulation,technological support,and alignment with international standards.Moving forward,efforts should focus on strengthening legal implementation mechanisms,optimizing tax regulation policies,advancing technological innovation,and promoting the integration of China's mineral resource legal framework with international mining regulations.These measures will ensure fair,efficient,and sustainable utilization of mineral resources,fostering a more resilient mining governance system.
