Abstract:The"dual carbon"goals(carbon peaking and carbon neutrality)represent a major strategic decision for China to address climate change and promote sustainable development,whose realization relies heavily on the supportive framework of a rule of law-based business environment.Through in-depth exploration of the theoretical connections between the"dual carbon"goals and the rule of law-based business environment,their scientific connotations and value orientations can be clearly grasped.The current rule of law-based business environment under the"dual carbon"context demonstrates distinctive characteristics of integrating history with the times,unifying theory with practice,balancing the whole with regions,and harmonizing the local with the global,while also facing realistic challenges such as incomplete legal systems,shortcomings in law enforcement and supervision,deficient evaluation systems,and difficulties in transforming development models.Based on thorough examination of international experiences and domestic practices,multi-dimensional development paths can be constructed:firstly,improving legislative frameworks through specialized carbon neutrality legislation;secondly,innovating regulatory enforcement methods to optimize carbon emissions trading oversight;thirdly,strengthening judicial civilization to enhance the efficiency of environmental dispute resolution.These pathways offer a systematic solution for establishing a rule of law-based business environment aligned with the"dual carbon"requirements,facilitating the organic integration of green-low-carbon development and rule of law advancement.
