Abstract：As a structure of the socialist market-oriented economy has been established in our country, the economic quality and legal property of the relationship between medical care providers and patients are manifesting themselves. The public welfare property of health economy in our country determines that the relationship is non-economical as well as unequal. At present, there are no specified laws governing this relationship, therefore, we are facing confusions in terms of regulating the relationship. The author of this paper believes that in order to improve the relationship, the top priority of the moment is to approve the concept that medical service is a special type of services, different from the others with its own property and its own regularity. Consequently, the punishment on medical professionals should be appropriate so as to protect the interests of patients.
