Abstract：Once a major safety accident take place, in order to avoid intensified social contradictions andquickly calm things down, maintaining social stability, the government often takes the form of administrativepayment to cope with the aftermath of a disaster .The initiative, timely and generous government giving is undoubtedlya great comfort for the victims.But the legal nature of the government administration compensation isunknown, even lack of legal enforcement programs may cover up the responsibility of the government supervi -sory negligence in production safety accident.The above problems make us think deeply about how to legallyspecify rules and procedures of the government ’s administrative compensation after the major safety accident .
