Abstract：During the 20th century, 70 countries around the world set off the development of the Occupational Safety and Health Act of climax, as a result of historical tradition, cultural background differences, the Occupational Health and Safety laws, de- crees have emphasized the protection of employees while protecting the rights of employers, our country so far in the Occupational Safety and legislation is still blank. However, China＇ s Taiwan region, the Occupational Safety and Health Act to protect the rights of employees with any country is different, it is different from all other countries is that the whole system of laws regulating the rights of the employees of the supreme, and no mention of the rights of employers, so that the provisions of the workers demonstrated a high degree of attention to basic human rights. For a long time stressed the national interest above personal interests and collective interests above personal interests, ignoring the individual rights of the legislative system to protect Taiwan＇ s occupational safety legislation is no doubt provide us with a successful model.
