New model of cross-border data regulation in Singapore:performance,characteristics,and implications

Abstract:Singapore has established a compromise and harmonized cross-border data regulation model through trade mechanisms,standardization mechanisms,and certification mechanisms.This model,reflected in tools such as the"Digital Economy Agreement"(DEA)and the ASEAN"Data Management Framework"(DMF),demonstrates a fusion of American and European regulatory rules.However,due to the issue of"rule fragmentation",this model faces challenges in practice,making it difficult to fully resolve the conflicts between American and European regulations and failing to achieve true coordination and compatibility of global regulatory standards.This paper proposes that future cross-border data regulation should emphasize the dual balance between data utilization and governance,as well as domestic and international regulation.Additionally,it should enhance the interoperability of rules in form and continue to address the issue of the digital divide.
