The conceptual changes and historical origins of cultural heritage legislation

Abstract:Cultural heritage is not only the crystallization of a nation's splendid culture,but also a witness to a country's long history.Compared with cultural property,cultural heritage has richer connotations and broader extensions,including two types:tangible cultural heritage and intangible cultural heritage.In the development process of cultural heritage legislation,the legislative concept has undergone a transformation from"monument protection"to"cultural identity protection",and the scope of protection has also expanded from"material cultural heritage"protection to"intangible cultural heritage"protection.From the adoption of"the Athens Charter on the Restoration of Historical Monuments"to"the promulgation of the Convention for the Safeguarding of the Intangible Cultural Heritage",it marks the gradual improvement of legislation on world cultural heritage.From the emergence of legislation on cultural heritage in modern times to the promulgation of multiple cultural heritage-related laws such as"Cultural Relics Protection Law"and"Intangible Cultural Heritage Protection Law",China has gradually formed a relatively complete system of cultural heritage legislation.
