On the Admissibility of Evidences in Preliminary Investigation

Abstract:Whether the evidences in preliminary investigation have the admissibility is a controversial question. The basic reason caused is the different opinions on the relation between preliminary investigation and case registration procession. If the case registration procession can be recognized and understood from a dynamic and general perspective, it is not difficult to find out that the question about the legality of obtaining evidences at this stage, which triggers the debate of the admissibility of evidence in preliminary investigation, does not exist. On this basis and together with the support of judicial interpretation and legal practice, the admissibility of evidences in preliminary investigation can be confirmed. In practice, applying to this kind of evidences should go through necessary examination and regulation.
