The Implementation of Criminal Guiding Cases and Its Solutions---Based on Empi rical Analysis

Abstract:To eliminate the“identical cases having different verdicts” ,the Supreme Court established the Case Guidance System and released a number of guiding cases .The empirical research found that the im-plementation of the Criminal Case Guidance System was not optimistic ,and it did not work well .The reasons includes that judges are too busy to learning guiding cases ,lacking standards to judge the similar cases ,and the effectiveness of criminal guidance cases is vague .Therefore ,establishing guiding cases database ,training judges ,exploring the criteria for judging similar cases and enduing criminal guiding cases clearly mandatory binding are necessary .
