The Spirit of Fair Play in Evidence Law. the Sample of the U.S. and the Prospect of China
Abstract:Fair is one of the values which the law pursues. Fair play in trial is the description of fair in the law. Keeping fair play in trial depends on the background of the trial system. The foundation of fair play in trial is the adversary system and the trial by jury. In addition to these two backgrounds, the implementation of fair play can't be separated from the Federal Rules of Evidence. The admissibility is the foundation of fair play, the cross-examination is the skills of fair play and, the character evidence of the defendant is a reasonable boundary of fair play. The spirit of fair play in the Federal Rules of Evidence sets a good example for China.
