Legal Guarantee for Optimizing the Market-Oriented Allocation System of Public Data Elements

Abstract：As an important component of the data field,public data elements are a key link in promoting social and economic development and enhancing the modernization of government governance capabilities.Authorized operation of public data provides a beneficial path for releasing the value of public data elements and driving the development of the digital economy.In the process of market-oriented allocation of public data elements,there are still prominent problems such as unclear ownership of public data,disputes over the definition of transaction objects,incomplete rights protection mechanisms,and potential risks in authorized operation.To address these issues,optimization measures should be implemented,including clarifying the state ownership of public data,constructing a balanced interest mechanism for relevant subjects,establishing a unified and multi-level rights protection system,and improving the public data opening and authorization mechanism in multiple aspects,so as to establish a healthy,adequate and sustainable market-oriented allocation system of public data elements.
