Logical Path and Normative Structure of Environmental Health Rights in the Environmental and Ecological Code

Abstract:Safeguarding public health is a key objective of China's environmental legislation.Environmental health rights,centered on environmental health interests,serve as an important carrier for protecting public health.Regarding the inclusion of environmental health rights in the code,there is a close logical connection between these rights and the compilation of the Environmental and Ecological Code.The codification of environmental health rights can follow the"General Provisions-Subsections"structure,adopt a moderate legislative model,and take a"one body with two wings"path.In the General Provisions,define their connotation,allocate rights and responsibilities,and specify remedies;in the Pollution Prevention Subsection,elaborate on institutional safeguards;in the Ecological and Environmental Liability Subsection,explore damage remedies.This study provides theoretical references for legalizing environmental health rights.
