A Study on Juvenile Delinquency Cases in Yi Jian Zhi

Abstract:The male youth of Song Dynasty in ancient books,or the legal term"teenage male"of the time,refers to young males aged from 16 to 20 who were not adults yet.Based on the Song Criminal Code and combined with the juvenile crime cases in the book Yi Jian Zhi,according to the degree of social harm in descending order,the juvenile crimes in the Yi Jian Zhi mainly include the evils of unfilial piety,murder,theft,and rape.Among them,some of the unfilial piety mentioned by officials and civilians in the Song Dynasty was actually a crime of violating religious orders by descendants;juvenile murder and homicide cases often occur due to instigation;juvenile theft cases reflect juvenile gang theft;juvenile rape cases are more common than rape cases,and the crime of rape may also evolve into murder.These juvenile delinquency cases not only undermined human morality,social management order,and social hierarchy,but also challenged the identity legal system of the Song Dynasty.
