The Normative Construction of Facts in Criminal Cases

Abstract：The fact of criminal case is different from the pure objective fact in that it possesses subjectivity.Compared with the absoluteness and uniqueness of objective facts,facts of the criminal cases have different features from different angles.It is just because of the phased development and diversified construction that the facts of cases show different images for different lawyers at different stages.In general,the facts of case are first sketched out by people's preconceptions,then reconstructed by legal thinking and legal norms,and eventually tend to be standardized and have their own value under the evaluation of legal codes.
