Undue Process and Human Rights ——From the Visual Angle of the Criminal Law

Abstract：Legal process is divided to two parts--due process and undue process by judicial justice. Due pro-cess and undue process are different from each other in forms, because the goal of them is different. For the pur-pose of protecting human rights in criminal law, this article tries to introduce the concepts of damage in undue process and the research approach of criminal law to other people, so we can explain the relationship of due pro-cess and human rights. And so we can reveal the importance of due process for the human rights from the reverse side of it. i hope that this research can help the criminal law of our country smoothing development.
