Haven Principle in the Field of the Network Copyright Interpretation

Abstract："Safe haven"principle is the result of the digital millennium Copyright Act (DMCA), embodied the principles and aims to alleviate the network service providers responsibility, maintain normal order of the in-formation network transmission right protection ordinance but impede the judicial practice in our country, im-plementation effect and even run counter to the original intention, and this kind of phenomenon is mainly due to the regulations of related elements and its applicable interpretation of differences and misunderstanding. Study and correct interpretation of the rules embodied in the "safe haven" principle, for the protection of the parties to civil rights, maintain normal order in the Internet, and promote the benign development of the net-work copyright has important theoretical value.
